While the damage remedies and attorney fees provisions of the Consumer Sales Practices Act are equally applicable to violations of the provisions relating to residential mortgages, a significant restriction on the right of rescission under the Consumer Sales Practices Act was included in the legislation. Under 1345.09(A), a consumer may elect to rescind a transaction, rather than recover damages, when a violation of the act has occurred.
